1. Introduction
1.1 These terms and conditions (the “Terms”) govern your use of the Plan Vivo Foundation website at https://www.planvivo.org (the “Site”).
1.2 By accessing or using the Site you accept and agree to be bound by these Terms. If you do not agree, do not use the Site.
1.3 We may change these Terms from time to time; the “Last updated” date at the bottom of this page shows when these Terms were last revised.
2. Who we are and contact details
Plan Vivo Foundation is a charity registered in Scotland (Charity No SC040151). Registered address: 4 Gayfield Place Lane, Edinburgh, EH1 3NZ, UK. Contact: info@planvivofoundation.org for data enquiries and/or admin or other queries.
3. Access and availability
3.1 We aim to keep the Site available but cannot guarantee uninterrupted access. We may suspend, withdraw or restrict access to parts of the Site for operational reasons (including migration, maintenance, backups).
3.2 The Site is hosted on Craft Pro. We use the hosting provider’s security, backups and infrastructure as part of the Site’s operation. We will maintain a Data Processing Agreement (DPA) or equivalent with our hosting provider to protect personal data. (See Privacy Policy for details.)
4. Use of the Site — permitted and prohibited activities
4.1 Permitted use: view, download and print pages for personal, non-commercial use, use donation/purchase features and create accounts where offered.
4.2 Prohibited use: using the Site to upload illegal content; automated harvesting or scraping without written consent; attempting to bypass security; transmitting malware; and using site content for commercial resale except as authorised under licence.
5. Accounts, registration and security
5.1 Where you register for an account you must provide accurate information. You are responsible for maintaining the confidentiality of your password and account.
5.2 We may permit organisational accounts that multiple people can access; the account owner is responsible for authorised users.
5.3 We reserve the right to suspend or terminate accounts for breaches of the Terms.
6. Donations, purchases and payment
6.1 Any donation, purchase or payment made through the Site is subject to our donation/payment terms and, where applicable, third-party payment processors’ terms. Payment card details are processed by authorised payment processors; we do not retain full card details on our servers.
6.2 Receipt of payment and effective contract formation occurs only on successful confirmation by the payment processor.
7. Your content and licences
7.1 “Your content” means any material you submit to the Site (text, images, files, comments). By submitting content to the Site, you grant Plan Vivo a worldwide, non-exclusive, royalty-free licence to use, copy, store, adapt, publish and display such content in connection with the Site and Plan Vivo’s activities.
7.2 You warrant you have all necessary rights in the content you upload and that it does not breach any law or third-party rights.
8. Intellectual property
All content on the Site (text, graphics, logos, images) is owned, licensed or permitted for use by Plan Vivo unless stated otherwise. You may not re-use our trademarks or republish material without prior written permission.
9. Third-party links and services
The Site may contain links to third-party websites and services. We are not responsible for the content or privacy practices of third parties. Use such third-party services at your own risk.
10. Liability
10.1 To the fullest extent permitted by law, Plan Vivo excludes liability for loss of profit, loss of business, loss of data, or indirect or consequential loss arising from use of the Site.
10.2 Nothing in these Terms limits liability for death or personal injury caused by negligence or other liabilities that cannot be excluded under applicable law.
11. Security and data protection
11.1 We treat data security seriously. The Site uses reasonable technical and organisational measures (including encryption for sensitive fields, secure hosting, and backups) to protect personal data. However, internet transmission is not completely secure and we cannot guarantee absolute security. 12. Changes to the Site or these Terms
We may modify the Site or these Terms for legal, security, or operational reasons. We will publish the updated Terms on the Site and update the “Last updated” date.
13. Governing law and jurisdiction
These Terms are governed by the laws of Scotland (or the relevant part of the United Kingdom where Plan Vivo is registered). Disputes will be subject to the exclusive jurisdiction of the Scottish courts.
